Terms & Conditions

The terms on which Suphan Counsel provides its services — stated plainly, so that both sides understand what to expect from the outset.

1. About These Terms

These Terms and Conditions govern the relationship between Suphan Counsel ("we", "us", "the practice") and any person ("you", "the client") who engages our legal services or uses this website at suphanco.pro.

By engaging our services or continuing to use this website, you confirm that you have read and accept these terms. If anything here is unclear, please ask us before proceeding — we are always willing to explain.

2. Our Services

Suphan Counsel provides legal support for pension-related matters in Thailand. Our current service offerings are:

  • Pension Position Assessment (฿7,100): a measured review of your pension matter, drawing together relevant decisions, dates, and documents, with a clear explanation of the picture and your available options.
  • Appeal Preparation Support (฿11,200): assistance preparing an appeal or formal response, including drafting, organising evidence, and advising on the steps ahead.
  • End-to-End Pension Representation (฿13,900): comprehensive representation for matters needing sustained attention, from preparation through submissions and advocacy to resolution.

Nothing in these terms or on this website constitutes legal advice for your specific situation until a formal engagement has been agreed in writing. General information provided before engagement is shared in good faith but does not create a solicitor-client relationship.

3. Engagement & Scope

A formal engagement begins when both you and Suphan Counsel have agreed the scope of work in a written engagement letter or service confirmation. The scope of work is limited to what is described in that agreement. Work falling outside the agreed scope will be discussed with you separately before it is undertaken.

We reserve the right to decline any engagement at our discretion, including where a matter falls outside our areas of practice or where there is a conflict of interest. If we are not the right fit, we will tell you honestly and, where possible, suggest where else you might turn.

4. Fees & Payment

Our service fees are as listed on this website and confirmed in your engagement letter. All fees are stated in Thai Baht (฿) and are inclusive of VAT unless expressly stated otherwise.

  • For the Pension Position Assessment and Appeal Preparation Support services, payment is due in full at the time of engagement unless a different arrangement has been agreed in writing.
  • For End-to-End Pension Representation, a payment schedule will be agreed and set out in the engagement letter before work begins.
  • Disbursements (such as court filing fees, courier costs, or certified translation fees) are charged at cost and will be communicated to you in advance where possible.
  • Invoices are payable within 14 days of issue unless otherwise agreed.

Where payment is overdue, we reserve the right to pause work on your matter until payment is received. We will give you reasonable notice before doing so.

5. Client Obligations

To allow us to assist you effectively, you agree to:

  • Provide accurate and complete information relevant to your matter, and to inform us promptly of any material changes.
  • Supply requested documents within a reasonable timeframe, particularly where deadlines apply.
  • Respond to our communications in reasonable time — our ability to assist you depends on your cooperation.
  • Not instruct another adviser on the same matter without informing us, to avoid conflicting advice or wasted effort.
  • Make payment as agreed, understanding that unpaid fees may affect the continuity of work on your matter.

6. Confidentiality

We treat everything you share with us as strictly confidential. We will not disclose information about your matter to any third party without your consent, except where we are required to do so by Thai law, court order, or regulatory obligation — in which case we will inform you if we are legally able to do so.

Our confidentiality obligation continues after the conclusion of your matter and after the termination of any engagement.

7. Intellectual Property

Work product created specifically for you in the course of an engagement (such as drafted submissions or formal opinions) belongs to you once full payment has been received for that work. We retain the right to use anonymised, general methodologies and know-how developed through our practice.

All content on this website — including text, layout, and design — is the property of Suphan Counsel and may not be reproduced without our written permission.

8. Limitation of Liability

We take care in everything we do and we will tell you honestly if we believe a particular course of action carries material risk. However, legal outcomes are not within our control, and we cannot warrant any particular result for your matter.

To the fullest extent permitted by Thai law, our total liability to you in connection with any engagement shall not exceed the fees paid by you for that specific engagement. We shall not be liable for indirect or consequential losses.

Nothing in these terms limits liability for fraud, wilful misconduct, or any matter that cannot lawfully be excluded.

9. Termination

You may end an engagement at any time by giving us written notice. We will invoice for work completed to that point, calculated at a reasonable daily or hourly rate where a fixed-fee service has been partially delivered.

We may also bring an engagement to a close where there is a conflict of interest, breakdown of trust, failure to provide necessary information, or persistent non-payment — in which case we will give you as much notice as practicable and take steps to minimise any prejudice to your position.

10. Complaints

If you are unhappy with any aspect of our service, please raise it with us in the first instance by writing to [email protected]. We will acknowledge your concern within 5 business days and aim to resolve it within 20 business days.

If we are unable to resolve your complaint to your satisfaction, you may refer the matter to the Lawyers Council of Thailand, which regulates legal practitioners in this jurisdiction.

11. Website Use

This website is provided for general information purposes. Nothing on it should be taken as legal advice for your specific circumstances. While we take care to keep information accurate and current, we cannot warrant that all content is free of error at all times.

12. Governing Law & Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Thailand, including the Civil and Commercial Code and the Lawyers Act B.E. 2528. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
